Internet Surveillance Working Group Report : Terms of Reference 26/10/00

The working group is established to:

1. Investigate and formulate policy recommendations on the surveillance and interception of communication on the Internet including but not limited to email, including:

a. When such surveillance is (and is not) appropriate

b. What safeguards should be in place to ensure the surveillance is appropriate to the situation and properly targeted

c. Practical aspects as to how any surveillance required should be performed with a view to informing Government and other interested parties when such surveillance is considered.

2. Investigate and report on privacy on the Internet including:

a. Users expectations of privacy

b. Collection and use of Internet usage records and other personal information about Internet users

c. Policy for sharing or revealing such records

d. Policy for protecting private information (including but not limited to usage records, and email) on the Internet from inadvertently falling into the wrong hands

e. The application of the Privacy Act 1993 to these records

f. The appropriateness of using encryption technology to assure privacy, and whether a user of encryption technology should be compelled to reveal the decrypted message.

The working group should consider the expectations of current Internet users, the practical aspects of implementing its recommendations on ISPs and other technical organisations, and the effect on policing of any restrictions on the ability to intercept information. The working group should also consider overseas experiences with Internet surveillance and privacy including legislation that has been enacted and/or considered, and instances where such surveillance has been beneficial to policing.
