Current Position
Preliminary work in scoping a project to develop a new Internet Code commenced towards the end of July. The results of this work are summarised in the attached document - Project Initiation Plan: New Zealand Internet Code. The initial phase has involved research into the issues that need to be considered for inclusion in a new code; these have been summarised in a draft Discussion Document.

Research
The Codes of Practice used to provide the starting point for a New Zealand Internet Code are:

  • Existing InternetNZ Code of practice (1999)
  • UK Banking Code of Practice
  • Irish Internet Code of Practice
  • Canadian Internet Fair Practices Policy Statement
  • Direct Marketing NZ Code of Practice
The relevant clauses from each of these codes have been summarised for each issue.

The New Zealand Internet Industry
The database of Internet Service Providers used for the preliminary survey by Nicky Duckworth has been used as the starting point for identifying industry stakeholders. These have been classified according to their strategic importance in the development of a new Code. Acceptance by "Influencer" stakeholders and the majority of "Primary" is considered to be essential if the new Code is to be taken seriously.

Timings
It is proposed that the Industry consultation process commence in September 2003 with the publication of the Discussion Document on the InternetNZ website. The objective is to complete the consultation and launch the new code in March 2004.

Budget
The initial phase covering the preliminary research and project planning, due for completion by the end of August was capped at $15,000 + GST. The budget required to carry out the consultation process, seek formal legal advice as required, and publicly launch the new Code is expected to cost approximately $100,000 + GST (spread over seven months).

Recommendations
That the Council

  1. note progress with this project;
  2. establish an Internet Code Steering Committee;
  3. approve commencement of the consultation phase, based on the draft Discussion Document;
  4. approve in principle a budget of $100,000 + GST for the period to 31 March 2004
