The Committee, renamed from Legal & Regulatory, met on 29 July 2005..

1. UBS Determination

1. Received positive feedback on our participation at the Technical Workshop
2. Asked office to prepare cost summary showing income and expenditure for each of the four stages being submission, cross-submission, conference and workshop.
3. Telecom have threatened a legal review of any Commission decision. The Committee does not support InternetNZ being a party to any court action.

2. Anti-Spam

1. Legislation has been introduced to Parliament
2. InternetNZ has asked all parties to support the bill at first reading. It has strongly supported the bill, with the exception of the proposed enforcement regime which would place considerable costs on ISPs
3. Legal advice on the Bill has been commissioned from Lowndes Jordan
4. A half day workshop is planned to develop an alternate enforcemenrt mechanism to propose to Government. This is provisionally scheduled for the week commencing 19 September.

3. ISPANZ

1. The Committee noted the formation of ISPANZ and supported InternetNZ’s offer of support to ISPANZ\
2. It was felt however that if ISPANZ had membership restrictions, this would limit the support InternetNZ could give ISPANZ. Any initial restrictions no longer exist.

4. Internet Code of Practice

1. Key area to resolve is the issue of enforcement.
2. Was resolved to have a half day workshop (will also be in week commencing 17 September) to consider a range of enforcement models ranging from ‘moral sanction’ only to ability to ‘fine’.

5. Cyberlaw Fellow

1. Good progress has been made with regards to an appointment.
